EEOC: Denny's Restaurant Serves Discrimination

The U.S. Equal Employment Opportunity Commission (EEOC) has filed a discrimination law suit against the popular restaurant chain Denny’s. The law suit alleges discrimination against disabled employees who were not provided reasonable accommodation as required by the American Disabilities Act (ADA) and fired after denial of medical leave related to their disability.

The suit was filed in response to a restaurant manager who recently had a leg amputation. Though she expressed a desire to continue working, she was told that she could not return, and upon expiration of her medical leave time, she was fired.

EEOC also alleges that Denny’s maximum medical leave policies were maintained even in the face of clear conflict with ADA requirements. Title I of the ADA prohibits discrimination on the basis of disability for the private sector, as well as state and local governments.
